Most 457 visas are granted on the basis of sponsorship by an Australian or Overseas business. The 457 visa process involves three steps:- (1) Approval of employer as a standard business sponsor for the 457 visa. (2) Nominations of the 457 Visa Application (3) The 457 Visa Application Approval of employers for the 457 visa process is the same for Australian and overseas employers except the latter need not demonstrate a satisfactory record of training of Australian residents. A sponsorship approval for 457 visa employers is valid for two years and may cover a certain number of 457 visa nominations. A 457 visa sponsor must have a lawful business and there must be benefit to Australia, an ability to meet 457 visa sponsor obligations, satisfactory compliance with Australian immigration law and no adverse information. Benefit to Australia - creation of or maintaining of employment for Australian citizens or permanent residents. It is possible to argue that skills provided by 457 visa applicants will allow business expansion and thus enhance employment. SELF SPONSORSHIP - a business owner may sponsor themselves for a 457 VISA. This excludes a sole trader and thus a corporate owner would be required. |
