ENS Visa
Employer Nominated Migration Scheme
     
The ENS Visa allows Australia employers to nominate skilled workers from overseas for permanent residence in Australia.

There are three categories of ENS Visa:-
(a) Employer nomination Scheme
(b) Regional Sponsored Migration Scheme "RSMS"
(c) Labour Agreements "LA"

Nomination by employees under the ENS must be lodged at the Immigration Department Business Centre as must an ENS Visa application. ENS Visas valid for five years and after that ENS employees must become citizens or apply for another visa.

ELIGIBILITY FOR BRIDGING VISA
A valid application made in Australia for an ENS Visa will entitle ENS applicants to obtain a bridging visa.
ENS Visa applicants require health checks and health and character checks.
The ENS is for highly qualified people who wish to obtain a permanent ENS visa.
There are two ENS stages:-

  • Approval of ENS employer nomination
  • ENS nominee application for a visa
  • Under ENS there is with all visas an offshore ENS subclass 121 Visa and an onshore ENS subclass 856 Visa.

With respect to nominations, it should be noted that all applications for approval must relate to the particular position and not to an individual. Approval of a nominations for an ENS Visa requires:-
  • Employer not to be subject to actions re breaches of obligation under 457 visa applications.
  • Active lawful operation of business in Australia.
  • Need for paid employees.
  • ENS employers to be of good standing ie good compliance record with Immigration and workplace relation laws.
  • ENS employers to make and continue to make good provision for training of existing employees.
